Terms of Service

1. Introduction

AstroNoir.ai (the "Service") is operated by EML MEDIA DOO, a company registered in the Republic of Serbia (Heroja Maričića 93, 36000 Kraljevo · Reg. 21632392 · PIB 112236243). By creating an account or otherwise using the Service, you ("you" or "User") agree to be bound by these Terms of Service ("Terms") and by our Privacy Policy, Refund Policy, Cookie Policy, and Acceptable Use Policy.

2. Service description

AstroNoir.ai is an AI-powered personalized astrology platform. We use your birth data, real astronomical calculations from the Swiss Ephemeris, and large language models to generate personalized horoscope reports, transit alerts, compatibility analyses, and related cosmic content.

3. Entertainment disclaimer

All readings, reports, and alerts are AI-generated and provided strictly for entertainment and informational purposes. They are not professional advice and must not be used as a substitute for guidance from qualified medical, financial, psychological, legal, or other licensed professionals. You acknowledge that any decisions you make based on the Service are made at your own risk.

4. Account & eligibility

• You must be at least 18 years old, or 16 with verifiable parental consent where local law permits.
• You must provide accurate birth data (date, time where known, place) for the Service to function correctly. You are responsible for the accuracy of the data you submit.
• One natural person, one account. Bulk account creation is prohibited.
• You are responsible for keeping your login credentials confidential and for all activity on your account.

5. Subscription & billing

The Service is offered in three tiers, with both subscription and a limited Lifetime option during our launch phase:

• Free — no charge, ad-supported.
• Starter — monthly or annual subscription.
• Pro — monthly or annual subscription.
• Pro Lifetime — one-time purchase. Limited availability. See section 5b.

Pricing varies by country. We deliberately offer lower prices in countries with weaker purchasing power so that AstroNoir is affordable everywhere we operate. The price you actually pay is determined by the payment channel based on your billing country, and may also include local VAT or sales tax applied by the channel — the final amount, in your local currency, is always shown to you before you confirm payment. Indicative prices are listed on our pricing page in your country's local currency; the channel's checkout screen is authoritative.

Paid plans are processed through one of two first-party payment channels, depending on where you purchase:

• If you purchase inside the AstroNoir Android app, your payment is processed by Google Play (Google LLC) under its own Terms of Service. Google Play acts as the payment processor and handles billing, taxation, and invoicing.
• If you purchase on the AstroNoir.ai website or installed PWA, your payment is processed by Dodo Payments, Inc. (a Delaware-registered company) acting as our Merchant of Record. Dodo Payments handles billing, applicable sales tax and VAT, and invoicing in your local currency. By completing checkout on our website you also enter a direct contractual relationship with Dodo Payments under its Buyer Terms and Privacy Policy.

By purchasing a paid plan you agree to the applicable channel's terms in addition to ours. The same five paid offerings (Starter monthly, Starter annual, Pro monthly, Pro annual, Lifetime) are available on both channels, at parity pricing for any given country.

5b. Lifetime PRO (Beta Phase Offer)

During our launch phase we are offering a limited number of Pro Lifetime plans — a one-time purchase that grants ongoing access to every Pro feature without recurring billing. We deliberately do not offer a Starter Lifetime: if you believe in AstroNoir enough to commit for life, we want you on our highest tier. Lifetime is our way of saying thank you to the people who back us early, and we do not take that lightly.

What "Lifetime" means here

• Duration: for as long as the AstroNoir service is owned and operated by EML MEDIA DOO. No expiry date, no monthly bills, no auto-renewal.
• No usage caps: unlimited AI Chat messages, unlimited dream-journal entries, unlimited reports — every paid feature as it exists today and as it evolves. Because AstroNoir runs on hardware we own, we do not need to ration what you can ask. "Unlimited" actually means unlimited.
• One-time payment: a single one-time purchase, priced by country (see pricing page for your country's amount). Keep all Pro features for life, no monthly bills, ever.
• Refunds: handled by the channel through which you purchased (Google Play or Dodo Payments) — see section 8.

What we cannot promise — and why we are saying so upfront

We would rather you trust us than feel surprised later, so here are the edge cases we want to be honest about:

• Ownership change: if AstroNoir is one day sold to or merged with another company, we cannot legally bind future owners to honor Lifetime plans. We commit to making Lifetime continuity a condition in any sale negotiation, and we will do everything reasonably possible to advocate for our early supporters — but the final decision rests with whoever owns the service after a transfer. This is exceedingly rare for early-stage products, and not something we are planning, but we will not hide it from you.
• Service discontinuation: if the AstroNoir service is permanently shut down (which we have no plans to do), the Lifetime plan ends with the service.
• Major product pivots: if AstroNoir fundamentally changes direction (for example, becomes a different category of product entirely), we will notify Lifetime members at least 30 days in advance and offer reasonable transition options — including a pro-rated refund.

Fair use, in spirit

Your Lifetime account is for personal use. Sharing credentials, reselling access, or running automated/bot traffic against the API may result in suspension. Otherwise, use AstroNoir as much and as freely as you want — that is the whole point of Lifetime.

How to purchase

Lifetime plans are available on both purchase channels:

• In the AstroNoir Android app as a one-time in-app purchase, processed by Google Play;
• On the AstroNoir.ai website as a one-time payment, processed by Dodo Payments as Merchant of Record.

Like our subscription tiers, billing, taxation, and the refund process for each Lifetime purchase are handled by the channel through which you bought it, under that channel's standard policies.

Thank you for trusting us this early in our journey. Every Lifetime member is a person we want to take care of for the long haul, and we will do everything reasonably within our power to honor that — well past the size we are today.

5a. Free tier & advertising

Users on the Free tier may be shown advertisements served by Google AdMob / Google Ads. By using the Free tier you acknowledge and accept that:

• Ads are served by Google LLC through the AdMob / Google Ads platform, subject to Google's own Privacy Policy and advertising policies.
• Google may use device identifiers and contextual signals to serve relevant ads in accordance with your Google ad settings.
• We do not control the specific ads displayed and are not responsible for their content.
• Ads are displayed only to Free tier users. Upgrading to a paid plan (Starter or Pro) removes all advertising.

You can manage your Google ad preferences at adssettings.google.com.

6. Auto-renewal

Paid monthly and annual subscriptions automatically renew at the end of each billing period at the then-current price, until cancelled. Lifetime plans do not auto-renew — they are one-time purchases. Renewal charges are processed through the same payment channel you used to subscribe — either Google Play (using the payment method on file with your Google account) or Dodo Payments (using the payment method on file with your Dodo customer record). You may cancel at any time before the next billing date to stop further charges.

7. Cancellation

You may cancel your subscription at any time, with no questions asked. The path depends on where you originally purchased:

• Purchased in the Android app (Google Play): open the Google Play app → Subscriptions → AstroNoir → Cancel; or visit play.google.com/store/account/subscriptions in your browser.
• Purchased on the website (Dodo Payments): sign in at astronoir.ai → Settings → Subscription → Cancel.
• Either channel: email [email protected] with your account email and the request to cancel — we will process it through the correct channel.

After cancellation, your paid features remain active until the end of the billing period you have already paid for. No further charges will be made.

8. Refunds

Refunds are governed by the policy of the channel through which you originally purchased — we do not directly process payments. Whether a refund is granted, and in what amount, is ultimately the channel's decision.

• Android purchases (Google Play): governed by Google Play's refund policy. Decision rests with Google.
• Web purchases (Dodo Payments): governed by Dodo Payments' refund and chargeback policy. Decision rests with Dodo as Merchant of Record.

To request a refund, follow the instructions for the channel you used (see the Refund Policy for full step-by-step). In either case you can also email [email protected] and we will advocate on your behalf — but we cannot override either channel's decision.

Statutory consumer rights: if you are a consumer in the European Union, the United Kingdom, or another jurisdiction with mandatory withdrawal rights, those rights apply to your purchase regardless of the policy above. Nothing in these Terms limits rights you have under mandatory consumer-protection law.

9. Intellectual property

All software, designs, brand assets, calculation logic, prompt systems, and AI-generated content templates on AstroNoir.ai are the intellectual property of EML MEDIA DOO or its licensors. You may not copy, redistribute, resell, scrape, decompile, or reverse-engineer any portion of the Service. You may share individual personal reports privately, but you may not republish them at scale or use them to train third-party models.

10. User content

Content you submit (dream-journal entries, AI chat messages, ratings, profile information) remains your property. By submitting it, you grant us a limited, non-exclusive, royalty-free licence to process it through our AI pipeline solely to deliver the Service to you. We do not use your personal content to train third-party models.

10a. Service improvement & AI training

To improve the quality of the horoscopes, AI Chat responses, and other content we generate, we may use anonymized content produced through the Service — including AI-generated horoscope reports, astrological chart data, AI Chat exchanges, dream-journal interpretations, and the style-preference data we hold about you — to train and refine future versions of our self-hosted AI models. Before training, we anonymize the content by removing names, email addresses, and account identifiers.

This processing is based on our legitimate interest (GDPR Article 6(1)(f)) in delivering better content to all users. AstroNoir is a personalized astrology service offered for entertainment and informational purposes; we do not process content for medical, psychological, religious, or other sensitive-category profiling. The personality profile we maintain captures preferences such as tone, length, language, and style of explanation — it is a stylistic calibration, not a psychological assessment.

You may object to this processing at any time by emailing [email protected] with the subject “Opt out of AI training”. On request we will exclude your future content from training datasets, with no impact on your subscription or features.

We never sell your data, never share it with third-party AI providers, and never use your content to train models outside the AstroNoir system.

11. Privacy

Your privacy is important to us. Please read our Privacy Policy for full details on what we collect, why, how long we keep it, and the rights you have under GDPR and similar laws.

12. Prohibited use

You agree not to use the Service for any unlawful purpose, and specifically you must not:

• scrape, crawl, or use automated tools to access the Service;
• attempt to bypass authentication, paywalls, rate limits, or security controls;
• use the Service to harass, defame, or harm others;
• upload illegal, infringing, or malicious content;
• resell or sublicense access to the Service;
• impersonate another person or submit false birth data on behalf of someone without their consent.

13. Limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, EML MEDIA DOO shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total aggregate liability to you for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

14. Changes to these terms

We may update these Terms from time to time. Material changes will be announced via email and/or a banner on the Service at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

15. Governing law & disputes

These Terms are governed by the laws of the Republic of Serbia, excluding its conflict of laws rules. Any dispute that cannot be resolved amicably within 30 days of written notice shall be submitted to the competent courts of Kraljevo, Serbia. If you are a consumer residing in the European Union, you retain the rights granted to you by the mandatory laws of your country of residence.
